Arbitration is a private dispute resolution process that prevents you from taking legal action in court or joining a class-action lawsuit. Rideshare companies include mandatory arbitration clauses in their driver agreements. Instead of being heard in court, the claim is reviewed by paid arbiters and the judgement would be both final and private. Meaning, the case could not be used to encourage improvements in future labor law nor could it be appealed at the federal level. However, you have the right to opt out of this clause by following the instructions in the Terms of Service.
Uber makes it difficult to read the terms of service and properly opt-out. Rideshare Drivers United made a tool to cut through the legal jargon and get your rights back. Our right to opt out of this agreement is protected by law, and acknowledged by Uber in the terms when they write - "You will not be subject to retaliation if you exercise your right to opt out of this."
